Order Process:

Orders can be placed via www.avviivva.com and are considered accepted once payment has been received.
AVVIIVVA reserves the right to cancel or refuse any order at any time.

Pricing and Payment:

Payment must be made in full at the time of purchase.
Shipping charges will be added at checkout.
Please note that our prices do NOT include customs duties, taxes or other charges for items sold outside Switzerland.
AVVIIVVA reserves the right to change prices at any time without notice.

Customs, Taxes & Duties:

Customers who are having the product delivered outside Switzerland, may be subject to import duties or taxes upon arrival of the item in their country. By placing an order with us, you agree to assume full responsibility for any customs clearance fees, import VAT or excise duties that may apply to your order. These taxes and duties are required to be paid by the customer upon delivery. Please note that the shipping carrier may not release the parcel without prior payment for these fees.

ANY CHARGES IN RELATION TO CUSTOMS, TAXES, OR DUTIES ARE NOT INCLUDED IN THE PURCHASE PRICE ARE THE SOLE RESPONSIBILITY OF THE CUSTOMER.

Customs, taxes and duties are based on the declared value of the item (the price you paid minus standard shipping costs). As customs differs for each country, we recommend that you check with your country’s customs and border authority for an estimation. Please note that some authorities will not give an estimation until the package has passed customs in the country of delivery.

AVVIIVVA cannot be held responsible for any actions, costs, or delays caused due to these customs processes over which we have no control. We recommend contacting your local customs office for more information about possible duties and taxes.

Product Descriptions:

The products featured on the website are shown as accurately as possible, using unaltered photographs and detailed descriptions. AVVIIVVA's examination and assessment of merchandise is conducted with great attention to detail. AVVIIVVA's expertise and product knowledge come from many years of experience with authentic designer and vintage items. AVVIIVVA may not warrant that the information on this site will always be fully accurate, complete, or current. Any errors are unintentional and may be caused by circumstances beyond our control. Colors of items may appear differently depending on the computer/phone or iPad screen. We take all reasonable care to portray the item in the correct color, but we are not responsible for any differences in the interpretation of color.

Condition of Merchandise:

AVVIIVVA inspects each item for its condition and authenticity before offering them for sale. In the description of each product, AVVIIVVA will specify the general conditions of the item. The main characteristics of the products for sale are shown in with photos and descriptions. The products offered may not correspond to the real items in terms of image and color because of the calibration of the device of the viewer (internet browser or application on mobile or portable device). We aim to represent as close as possible to the reality of the product. However, AVVIIVVA disclaims all responsibility. Please be aware that luxury consignment pre-owned items may be delicate and may not be as resilient as a brand-new item. We do not accept, nor put on sale, any items that have smoke, pet, or musty odor. Please note that some vintage items – in particular fur or skins – may have a slight odor of the material, which is normal. AVVIIVVA is not responsible for any odors that infiltrate the product during transit.

AVVIIVVA sells exclusive, authentic pre-owned merchandise. We are not an authorised dealer and are not affiliated with the brands we sell on our site. Store-new designer items are only available from an authorised dealer or the actual store. Once the item leaves the authorised dealer with a customer, the item is considered pre-owned. However, items can be pre-owned and in new condition – that is, never used by the owner. 

We use the following definitions to describe the condition of each item:

• NEW CONDITION (9.9/10): Like new, never worn but tags/protective covering, box or dustbag may be missing.
  
  
• PERFECT CONDITION (9.8/10): Appears to have been used only a few times and is nearly new in condition. May have very slight signs of having been used upon close inspection.
  
  
• VERY GOOD CONDITION (9 to 9.8/10): Used and in excellent condition. There may be faint signs of wear, slight scratches, marks or nicks which are not particularly noticeable and will not affect the use or wear of the item. The descriptions and photographs of the item will clearly indicate the condition of the item.

Sizing:

AVVIIVVA uses the size specifications used by the respective brands. However, please note that brands have different standards with regards to the sizing of garments and shoes. AVVIIVVA can provide detailed measurements on request. It is however the responsibility of the buyer to check the measurements provided. AVVIIVVA is not responsible if a garment or pair of shoes do not fit perfectly, or if a bag handle/strap length or size does not match the buyer’s interpretation.

Shipping & Delivery:

AVVIIVVA will ship to the address provided by the customer. Shipping costs will be added to the total price at checkout. Delivery times may vary depending on the shipping method selected and the destination. AVVIIVVA is not responsible for any delays or issues related to shipping or delivery. The customer bears the risk over the goods upon their receipt by the carrier. Any dispute of damage in transit will be between the buyer and the courier and is not the responsibility of AVVIIVVA.

Sales and Returns Policy:

All items are sold “as seen”.
As all items are unique and pre-owned, should you have any questions about the item, the color, the size, the condition, or other, it is your responsibility to contact us with questions BEFORE purchase. We do not allow refunds, returns, nor exchanges on items, and no provisions are made for choosing the wrong size, buyer’s remorse, or fraudulent use of your credit card. Please note that Switzerland is outside the EU; thus, only Swiss law applies.

NO RETURNS AND NO REFUNDS: You automatically and electronically acknowledge our policy of "no return and no refund" when purchasing online, through the obligatory checking of the box that you have read our terms and conditions. Under Swiss law, there is no right of return. Thus any purchase made on our website outside of Switzerland also has no right of return.

Warranties and Liabilities:

AVVIIVVA declines all responsibility and cannot be held liable for any damages caused by the use of a specific item. AVVIIVVA cannot be held responsible for the quality of an item of any pre-owned item (we are not the manufacturer) or any damages resulting from a manufacturing defect. No warranties of any kind are given or implied. The risks of the item are transferred to the customer as soon as the item is handed over to the carrier; AVVIIVVA is not responsible for any damages or loss of the item during transit. In any event, any possible responsibility of AVVIIVVA shall not exceed the purchase price of the concerned item.

Privacy Policy:

At AVVIIVVA.com, we take the privacy and protection of our customers' data very seriously. We collect and process personal information only for the purposes of providing our services, and we do not share any customer data with third parties unless legally required to do so. AVVIIVVA.com is hosted on Shopify Inc. who provide us with the online e-commerce platform that allows us to sell our products and Services to you. The company uses industry-standard security measures to protect customer data from unauthorized access, modification, or disclosure.

Customers have the right to access, rectify, and delete their personal information, and to withdraw consent for processing at any time. By using our website, customers agree to our privacy policy and the collection, processing, and use of their personal information in accordance with it.

Governing Law and Venue:

This agreement shall be exclusively governed by Swiss law (Switzerland is not part of the EU).
The exclusive venue (with exclusion of any other venue) for any disputes shall be the ordinary courts in the Canton of Zurich, subject to remedies to the Federal Court.

Changes to the Terms of Service:

AVVIIVVA reserves the right to make changes to the Terms of Service at any time.
Changes will be posted on the AVVIIVVA website and will be effective immediately.
